Dispensaries

Medical Marijuana Dispensaries can be pharmacies, hospitals, nursing homes, community health centers, hospices, non-profit organizations, and for-profit businesses that are registered under the Department of Health (DOH) to legally sell and dispense medical marijuana to patients or their designated caregivers with valid registry cards for medical use.

There can be up to five licensed dispensaries in the state that will cultivate, manufacture, and dispense medical marijuana. Each organization can run up to four dispensaries. Dispensaries are allowed to operate within 1,000 feet of a school or church, but must be located around the block. A buffer zone has been proposed for medical marijuana dispensaries in New York, meaning the structure would not be allowed to open near places such as a school or a church.

Visiting a Dispensary

A person must be at least 21 years of age to visit a dispensary and must present required information and proof that he is legally allowed to obtain medical marijuana. When visiting a dispensary, the patient or the patient’s designated caregiver must present an identification card or registry card under DOH to purchase or obtain marijuana for medical use.

Starting a Dispensary

To start a dispensary, one is required to register with the Department of Health (DOH). The owners, officers, board members, and employees must present or submit all requirements, documentation, applications, and required fees. All applicants must be at least 21 years of age and with no past of any drug felony convictions. The dispensary will be evaluated by the Department of Health for qualifications.

• Must maintain good security with provided security equipments to prevent unauthorized entrance.
• Have sufficient facilities and land, or a bond of $2 million
• Have entered into a labor peace agreement.
• Is able to comply with all state laws.
• Demonstrate moral character of organizational officers.
• Receive registrations valid for two years, after which time renewal is required.
• Must report all sales, deliveries or distributions of medical marijuana to DOH.
• Each product should go through the DOH development safety requirements.
